4. Acceptable Use Policy (AUP)
To maintain the highest deliverability rates and protect our IP reputation, ProSMTPs enforces a strict zero-tolerance policy against spam and abusive behavior.
1. Prohibited Content and Activity
You may not use ProSMTPs to send, transmit, or distribute:
Spam / Unsolicited Commercial Email (UCE): You may only send emails to recipients who have explicitly opted in to receive communications from you.
Malicious Content: Emails containing viruses, malware, trojans, or phishing links designed to steal personal or financial information.
Deceptive Information: Emails with forged headers, misleading subject lines, or spoofed sender addresses.
Illegal Content: Material that violates any applicable local, state, national, or international law, including the CAN-SPAM Act, GDPR, or CASL.
2. List Management Requirements
All mailing lists must be strictly opt-in. Purchased, rented, or scraped lists are explicitly prohibited.
Every marketing or bulk email must include a clear, functioning, and easy-to-use unsubscribe mechanism. Opt-out requests must be honored immediately.
3. Bounce and Complaint Rates
We actively monitor account metrics. Accounts that generate excessive hard bounces, spam complaints, or hit spam traps will be subject to immediate review, throttling, suspension, or permanent termination.
4. Consequences of Violation
Violation of this AUP will result in the immediate suspension or termination of your ProSMTPs account without notice and without refund. We reserve the right to report malicious activity to relevant law enforcement agencies or anti-spam organizations.
